Big Creek Kennels Puppy Contract
1. Health Guarantee
Big Creek Kennels guarantees that your new puppy is free from communicable diseases and health defects to the best of our knowledge at the time of sale. We also guarantee that the puppy is of pet quality. This guarantee covers congenital health issues for a period of twelve (12) months from the date of purchase.
To ensure your puppy’s health, we advise that you refrain from taking your puppy to public places such as dog parks and pet stores until all required vaccinations have been administered. Although your puppy has received age-appropriate vaccinations, full protection will be achieved only after your veterinarian has confirmed clearance around 14 weeks of age.
If a health defect is discovered, the puppy must be returned to us in good condition, aside from the identified issue, following prior arrangement. This return must be at the buyer's expense. Upon return, the buyer may qualify for a replacement puppy. This guarantee is non-transferable and applies only to the original buyer/owner.
In the unfortunate event of the puppy’s death within six (6) months of purchase, the buyer is responsible for the cost of an autopsy to determine the cause of death. If the cause is determined to be congenital, all findings and reports must be submitted to and agreed upon by our veterinarian before a replacement puppy may be provided. The decision to replace the puppy is at the seller's discretion and contingent on the availability of a replacement puppy. This guarantee excludes problems resulting from accidents or injuries occurring in the puppy’s new home or during transport.
2. Veterinary Examination
To validate this health guarantee, the puppy must be examined by a licensed and fully credentialed veterinarian within seventy-two (72) hours of the puppy’s arrival in the buyer’s possession. The seller must be notified immediately of the examination results, along with a copy of the report and/or proof of the examination. Failure to comply with these requirements will result in the cancellation of this guarantee. Veterinary examination and treatment costs are the responsibility of the buyer and are not covered by the seller.
3. Breeding and AKC Registration
Our puppies are bred as companion animals and are not guaranteed for breeding or show purposes. If you intend to breed your puppy, you must inform us. AKC registration papers will be withheld until we receive a statement from your veterinarian confirming that the puppy has been spayed or neutered. After one (1) year from the date of purchase, no papers will be provided. On occasion, we may provide AKC limited registration papers.
4. Agreement
By signing below, you acknowledge that you have read, understood, and agreed to the terms of this guarantee. You also certify that you are at least eighteen (18) years of age.
5. Legal and Dispute Resolution
This contract shall be governed by and construed in accordance with the laws and statutes of the State of Kansas. Any legal disputes arising from this contract shall be resolved through mediation or arbitration, rather than through court. The mediator or arbitrator shall be mutually agreed upon by the parties, with the proceedings held in Neosho County, Kansas.
6. Right to Refuse Sale
Big Creek Kennels reserves the right to refuse sale or service to any individual to ensure our puppies are placed in suitable homes for a lifetime of happiness.
